Recently, Marsh & McLennan agreed to settle a class action lawsuit originally filed in March of 2010 by a group of Marsh & McLennan’s benefit consulting and actuarial analysts.
The original lawsuit alleged that Marsh & McLennan had violated federal wage and hour laws by failing to pay their analysts overtime. (The Fair Labor Standards Actrequires that employees be paid one and one-half times their regular rate of pay for all hours they work over forty in a given workweek.) Marsh had classified these analysts as exempt from the FLSA’s jovertime requirements, a common practice for companies wishing to avoid the cost of paying employees overtime.
While the terms of the settlement are confidential, the court will only approve the settlement if it reasonably compensates the employees given the losses they have suffered and the strength of their case. If the settlement is approved, it will serve as another example of how employees whose legal rights have been violated can successfully use class action suits to force employers into settlement.
