St. Louis Employment Law Attorneys: Call 314-528-9661

Is your employer unlawfully denying, reducing, or withholding your hard-earned wages? Take immediate legal action and contact Riggan Law Firm, LLC. For more than 30 years, we have represented individuals and groups involved in disputes regarding legally mandated minimum wage and overtime pay. We know the law, we know your rights, and we can help you fight for every penny owed.

Despite the fact that the federal minimum wage and overtime law was passed in the 1930s, many employers run afoul of the law. If you believe that an employer has acted outside of the law, our attorneys can fight to hold them responsible for their actions. Contact our St. Louis, MO attorneys to learn about your case.

We routinely handle minimum wage & overtime claims including:

  • An employer incorrectly classifies workers as exempt, denying the payment of earned overtime wages.
  • Employees paid on a “straight time” basis who are not paid overtime hours in accordance with state and federal laws.
  • Employees who are asked to perform work before clocking in or after clocking out for which they are not paid.
  • An employer fails to compensate workers for overtime that was not “pre-approved.”
  • Overtime pay is denied to commissioned employees who do not regularly travel away from the workplace.

Effective July 24, 2009, the minimum wage under federal law is $7.30 per hour. Employers are required to pay the federal minimum wage unless the applicable state’s minimum wage is higher. Missouri’s minimum wage for 2013 is $7.35 per hour. Effective July 1, 2010, the minimum wage in Illinois was increased to $8.25 per hour, which Illinois employers are required to pay since it exceeds the federal minimum wage.

Time Limit to Assert a Claim

If you believe that you have a claim, it is vital to act quickly. The law allows an employee to recover pay for a period of up to two years, running backward from the date of any lawsuit that is filed (three years if a willful violation has occurred). Our St. Louis, Missouri attorneys can help you understand if you have a case and how to overcome the legal challenges ahead.

In addition to recovery of unpaid wages, an employee who successfully files suit for unpaid minimum wage and/or overtime pay may be able to recover an equal amount in liquidated damages. Moreover, an employer who loses a lawsuit is typically required to pay for the employee’s attorneys’ fees and court costs.
